Pursuant to Article 2054 of the Italian Civil Code, the driver of a vehicle is obliged to compensate all damage caused to persons or property by the use of the vehicle if he can't prove that he has done everything to prevent the damage.

In Italy, in the event of a car accident between two or more vehicles, all drivers have contribuited equally to produce the collision and the damage. In fact, the Italian Law presumes a contributory negligence and guilty, until proven otherwise.

The owner (or the usufructuary) of the vehicle is jointly and severally liable with the driver, if he does not prove that the use of the vehicle took place against his will.

In any case, the owner shall be responsible for damage resulting from construction defects or failure to maintain the vehicle.
