The principle of reciprocity in Italy.
Treatment of foreign citizens and companies in Italy.
Pursuant the article 16 of the Royal Decree no. 262 of 16 March 1942, the foreign citizen is eligible to have access to civil rights granted to the Italian citizen only if the Italian citizens have the same rights and treatment in his country. This provision, called principle of reciprocity, also applies to foreign companies.
It is not necessary to ascertain the condition of reciprocity in relation to the violation of fundamental human rights, such as the right to life, safety and health (for example, the victims of car accidents in Italy have the right to receive a fair compensation, despite their nationality).
However this principle does not apply:
- natural or legal persons of the EU Member States and citizens of the EEA countries (Iceland, Liechtenstein and Norway);
- non-EU citizens who reside in Italian territory and are holders of a residence permit or a valid residence permit;
- stateless persons resident in Italy for at least three years;
- refugees resident in Italy for at least three years.
In addition, it is not necessary to verify the condition of reciprocity for the foreign citizens and companies of those countries that have concluded with Italy an agreement about promotion and protection of investments.
