The property relations between the spouses under the International Private Law in Italy
What is the national law applicable to property relations between spouses of different nationalities?
Pursuant to Law no. 218 of 1995, property relations between spouses are governed by the law applicable to their personal relationships, so by the common national law or, in the case of spouses of different nationalities or more common citizenships, by the law of the State where the marriage is mainly localized.
However, the spouses may agree that their property relations are governed by the law of the State of which one of them is a citizen or where one of them resides.
The agreement of the spouses on the applicable law is valid only if it is considered as such by chosen law or the law of the place where the agreement was signed.
The system of property relations between spouses governed by a foreign law is enforceable against third parties only if they have been aware of it or they have ignored because their fault.
