The recognition and enforcement of foreign judgments in Italy
How to enforce a foreign judgment in civil and commercial matters in Italy
Pursuant to Italian International Private Law, a foreign judgment is recognized in Italy without the need of any special procedure, if:
- the judge who delivered the judgment, could hear the case according to the principles of Italian Law about jurisdiction;
- the summons was duly served to the other party;
- the judgment has become definitive in accordance with the law of the place where it was delivered;
- the judgment is not contrary to any final judgment delivered by the Italian courts;
- there is no trial pending before an Italian court on the same matter and between the same parties;
- its provisions are not considered to be contrary to the public order in Italy.
